What about:
I copy a copy-protected CD on my old style tape, which I use in my car.
Am I a law-breaker?
I copy this copy back to my computer via line-in and make MP3-files from that.
Am I a law breaker?

In Germany you are a law-breaker.
It's generally not allowed to copy a cd with copy-protection. |

This is not true. The german law says, that the protection must be "effective", and as far as I know, there is no working protection that prevents you from making an analogue copy to tape.
IMHO this is perfectly legal in Germany. |

hi,
if you use an analog signal it's not illegal.
You could also hookup a DAT to your CD player or PC Soundcard.
If You have a Multichannel-Soundcard you could send the Audio-Out to the Audio-In. |

Wenn dein PC eine Mehrkanalfähige Soundkarte hat, kannst du eine CD einlegen, abspielen und das nun analoge Signal ueber die Soundkarte wieder Digitalisieren.
Du hast nun eine AnalogeQuelle digitalisiert und kannst davon wieder eine CD brennen.
Mich wundert, dass dies nicht in der FAQ zu finden ist..

Legale analoge Privatkopie
Die Neuregelung des Urheberrechts hat die grundsätzliche Zulässigkeit von Privatkopien zwar erhalten, den Anwendungsbereich jedoch stark eingeschränkt. Eine rechtmäßige Kopie muss ohne Umgehung wirksamer Kopierschutzmaßnahmen und nicht von einer offensichtlich rechtswidrigen Vorlage hergestellt werden.
Zulässig sind nach Ansicht der überwiegenden Mehrheit der Juristen aber auf analogem Weg erzeugte Kopien von kopiergeschützten digitalen Trägermedien. Denn die Schutzsysteme, mit denen digitale Kopien verhindert werden sollen, können und sollen Vervielfältigungen über analoge Eingänge von PCs nicht unterbinden.
Für eine solche Kopie, wie sie mit unCDcopy erstellt werden kann, sind die gängigen Kopierschutzeinrichtungen folglich keine „wirksamen technischen Maßnahmen“ im Sinne des § 95 a UrhG, sodass die Kopie rechtmäßig erstellt wird. Dies gilt auch dann, wenn aus der ursprünglich analog gewonnenen und geringfügig qualitativ beeinträchtigten Kopie anschließend eine neue digitale Kopie entstehen sollte, da das Gesetz allein auf den Vorgang des Überwindens einer Kopiersperre abstellt.
