On Point 11 in the german FAQ there ist the question of "undergoing" (don't know a correct translation, sorry) the copy protection. The answer states that if the CD is copy protected, you are not allowed to undergo the protection. (" Ist die CD kopiergeschützt, darf ich diesen Kopierschutz nicht umgehen."). I have the situation that I have a CD with the logo "copy controlled", and there surely is a copy protection on the CD, but my CD-ROM drive reads the CD anyway as if there is no copy protection. So technically by making a copy I would say that I didn't undergo (umgehen ) the copy protection, but what exactly does the law say about this?
Can I make copys of copy controlled CD's if my PC can't even see that there is a copy protection? Allowed or illegal? Keep in mind, I don't use special software to trick the protection, it's like copying a CD that doesn't have a protection. |

IMHO making a copy of such disc is perfectly legal, as the copy protection is obviously not working (being "uneffective").
According to german law technological measures have to be “effective”. (§ 95a (2) sentence 2), which this protection obviously isn't. |

You say that your "drive reads the CD anyway as if there is no copy protection". How can you tell?
Does the drive maybe circumvent the protection?
Does the software you use for copying circumvent the protection? |
