Article 27 of the Universal declaration of Human Rights declares that every individual has the right to access his cultural heritage. copy-protection systems that are actually access controls, combined with legislation that prohibits its bypassing is actually in violation with this human right, which, as far as I know has been accepted by the EU.
Similarly, in the US, the only reason that copyright can co-exists with the first amendment (protecting freedom of speech) is because of brought fair-use exemptions. Similar arguments can probably be made under the various European jurisdictions, although with less power. Since the directive effectively prohibits all fair-use for materials of which the author claims has copy protection, and the author has applied even the slightest scrambling, such legislation is probably also in violation with the various human rights people have in Europe. _________________ Jeroen Hellingman |
