| Please consider the following scenario: I live in Germany and rip a German TV show straight from TV to my hard drive. Am I allowed to give copies of this show to my friends? Am I allowed to share them over the internet? May I receive such copies from friends of mine? Is this the same with TV rips from other countries? |

My opinion on this matter:

Yes, because this is "private use" of copyrighted material you rightfully own.

No, because you offer copyrighted material to people outside your "social surrounding".

Yes, and as you have received copyrighted material rightfully, you may share it with your friends as well.

I believe the country does not matter. If you have received it as a gift from your friend, all is fine.

1.Would such transfers be legal if you sent it to a person who you commonly contact on the internet, however you do not know in person?
2.What if you only talked to them a couple times?
3.One time?
4.Somebody who you havn't talked directly to, but is also a member the same chat forum which you are a member of?
5.What if the community is more of a file sharing community of people who do not necessarily meet in person, but converse electronically?
Basically what I am asking is, What is considered to be your "social surrounding"? (btw, I live in the US so, I'm not familiar whith the intricacies of European copyright laws) |

I would say this depends on the judge, if such a case comes to trial.
My understanding is, that "social surrounding" must be someone you have personal contact (family member, good personal friends, maybe co-worker or schoolmate, maybe a neighbour), so you must know him in person.
So, all "no" to your questions.
(Disclaimer: I am no lawer, I have no idea what I am talking about... blabla...) |

Here in the Netherlands your "social surrounding" is VERY restricted and only applies to family and people who you consider family.
However you are talking about a US situation. In the US you have the "fair use" method to determine if something is "fair use". Maybe a little search on google could find more info on this.
(I'm no lawyer also!) |
